Is Declining to Be Searched, When You Did Nothing Wrong, Disorderly Conduct?

It was for a man recently arrested in a Loganville Walmart.

You're out shopping -- wearing some new jeans you bought at another store and forgot to remove the tag from. A store employee gets suspicious, and police ask you to step into the loss-prevention office so they can check out your pants to make sure you're not shoplifting them. You're not shoplifting, so you say no, you can't check out my pants. And out come the handcuffs. The charge for not cooperating, you're warned, is disorderly conduct. What do you do? A Loganville man recently opted for the disorderly conduct charge rather than agree to take his tag-on jeans to the loss-prevention office. Compliance with their request would negate civil action in a court of law. If innocent, refuse until you are in handcuffs, then you are actionable against the corporation and the police jurisdiction. I'll take my 30% off the top of that action anyday.   more ›

Man With Club Foot, Woman With Teeth 'Similar to a Meth User' Sought in Buford Shoplifting Incident

The incident was captured on video surveillance.

The Gwinnett County Police Department knows what two suspected shoplifters look like and now just has to find them. Officers were dispatched to a theft in progress call at the South Garnett Street Dollar General on Feb. 23. The manager attempted to stop a female suspect, but the suspect fought back and escaped before police arrived. The investigating officer noticed several items, including a yellow neon jacket, on the ground outside the Dollar General. The store manager advised the jacket belonged to the female suspect and had come off during his struggle with her. Inside the jacket, the officer located a bottle of methadone. According to the report, it is not known if the name on the bottle is that of the female suspect. Video …

Shoplifter Caught With Chicken Wings, Air Fresheners

The suspect had also attempted to steal several other items.

A Buford man was arrested on a shoplifting charge after a loss prevention officer saw him attempt to leave the Sardis Church Road Walmart with several items of merchandise on Dec. 14. The loss prevention officer told police the suspect, identified as Felton Montgomery, 21, of Buford, had picked up a backpack, put it on and then walked out of the store while also carrying a drink and chicken wings. When the loss prevention officer confronted Montgomery, he discovered a game controller adapter and three air fresheners in Montgomery’s pockets. Montgomery reportedly admitted stealing those items as well. The total amount of the merchandise taken was $38.97. Montgomery was transported to the Gwinnett County Jail. Walmart Shoplifter Stopped ‘at Taser Point’

Man is reportedly a suspect in other Walmart thefts.

A man believed to have been involved in a series of thefts was taken into custody after a failed shoplifting attempt at the Buford Drive Walmart on Dec. 9. A Walmart loss prevention officer called Gwinnett County Police after seeing a man he said was responsible for thefts at other Walmarts. The loss prevention officer followed the man, later identified as Kenneth Scott, 30, of Lawrenceville, through the store and watched as Scott loaded his shopping cart with merchandise. According to the loss prevention officer, Scott began to leave the store on several occasions but would then return inside to select additional merchandise. By the time Scott left the store, several Gwinnett County Police officers had arrived and were waiting outside. As…
