Couple Arrested in Connection With Road Rage Incident

A Nov. 28 road rage incident led to a minor accident and the arrest of a Sugar Hill couple.

Police were dispatched to Old Cumming Road and Nelson Brogdon Boulevard after a Buford man called police to report that a female motorist had pointed a gun at him.

According to the Buford man, he and a friend were driving to work when a woman, identified as Kimberly Dutton, 50, of Sugar Hill, pulled out of a driveway and nearly struck their vehicle. The Buford man said his friend had to swerve to avoid being struck by Dutton's vehicle.

"[The Buford man] stated that Dutton became upset over the incident and pulled out a silver snub nosed 38 revolver and pointed it directly at him," the officer wrote in the report.

The two men followed Dutton long enough to obtain her tag number and called 911. A short time later, the men noticed a red Dodge Ram pickup truck following their vehicle. The men said the truck passed them and the driver, Joe Dutton, 49, of Sugar Hill, allegedly tried to block their vehicle.

The men told police Dutton jumped out of his truck and began yelling at them and making threats. The driver was able to pull around Dutton's vehicle and continue on Old Cumming Road. As the two vehicles approached the intersection of Old Cumming Road and Nelson Brogdon, Dutton allegedly blocked the Buford men's vehicle once more.

"Dutton reached into the vehicle, grabbed [the driver] by his jacket collar and also the steering wheel," the report stated. "This caused [the driver] to panic and step on the gas."

As the driver was attempting to maneuver away from Dutton, he struck a Toyota Sequoia that was stopped between his vehicle and Dutton's truck. The two Buford men then pulled into a trailer park across from Old Cumming Road and waited for officers to arrive.

When interviewed by police, Joe Dutton said his wife Kimberly had called him and said she was being followed by a vehicle that almost hit her as she pulled out the driveway. Dutton admitted heading out to look for the vehicle, but denied blocking the vehicle or grabbing the driver. However, according to the police report, the driver of the Toyota Sequoia witnessed the incident.

Kimberly Dutton denied pointing the revolver at the Buford man saying she placed the gun in its holster on the dashboard of her vehicle. She was unable to explain to officers how the Buford man could provide such a detailed description of the weapon if she had not removed it from the holster.

Based on the statements from the parties involved and from the witness, the officer determined there was probable cause to place the Duttons under arrest.

Joe Dutton was taken into custody on a charge of simple assault. Kimberly Dutton was arrested on a charge of pointing a pistol or gun at another. Both were released later that day -- each on a $2,400 bond.
